The sudden death of business tycoon Sunjay Kapur has sparked a complex inheritance dispute involving his children from his marriage to Bollywood actress Karisma Kapoor. The 53-year-old automotive heir died of a heart attack in June 2025 while playing polo in Surrey, leaving behind a massive business empire worth approximately ₹30,000 crore.

Kapur's children, 20-year-old Samaira and 15-year-old Kiaan, have approached the Delhi High Court seeking their rightful share in their father's wealth. The hearing for their plea was held today, September 10, 2025, marking a key development in this high-profile case.

Senior Advocate Mahesh Jethmalani, representing Karisma Kapoor’s children, confirmed after today’s hearing that the suit will now be formally registered. “They have to make certain discoveries about the personal assets of Sunjay Kapur,” he said. The next hearing is scheduled for October 9, 2025.

As of now, there is no public statement from Priya Sachdev or Sona Comstar regarding the legal dispute or the authenticity of the will.

The inheritance dispute centres around a will that emerged under questionable circumstances. Initially, Priya Sachdev, Kapur's current wife, informed the children that no will existed. However, a will dated March 21, 2025, surfaced more than seven weeks after Kapur's death.

The children's legal team argues that this delayed revelation, combined with contradictory statements, raises serious questions about the document's authenticity. They have accused their stepmother of withholding crucial information about their father's final wishes.

Can Children Inherit Property After Their Parents’ Divorce?

According to Rohit Menon, Advocate at the Bombay High Court, a divorce settlement between parents cannot override a child’s statutory right to inheritance under Indian law.

“The bond between parent and child remains intact despite divorce proceedings,” explains a senior advocate at the Supreme Court of India. “Children are automatically classified as Class I heirs under Section 8 of the Hindu Succession Act, 1956, which ensures their legal right to inherit their father’s property after his death.”

He further adds, “Any financial agreement made during a divorce applies only to the spouses involved. Such settlements cannot cancel or affect a child’s legal inheritance. Indian law firmly protects these rights and does not allow them to be negotiated away.”

The advocate also clarifies that, “Divorce settlements create obligations only between the former husband and wife, and have no impact on a child’s separate legal standing. Even if a settlement exists, children maintain independent and protected rights under inheritance law.”

Sunjay Kapur’s Family Dispute Over ₹30,000 Cr Estate

The inheritance battle extends beyond Karisma Kapoor's children. Sunjay Kapur's mother, Rani Kapur, who previously served as Sona Comstar's chairperson, has also raised concerns about her son's death and subsequent corporate decisions.

In a letter to the company's board dated July 24, 2025, Rani Kapur described her son's death as occurring under "highly suspicious and unexplained circumstances." She also claimed to have been pressured into signing important documents while grieving and emotionally vulnerable.

"It is unfortunate that while the family and I are still mourning, some individuals have seen this as an opportunity to seize control and take over our family legacy," she stated in her letter.
