Right Against being stalked
The IPC’s section 354D allows legal action to be taken against the offender, who follows a woman or fosters her personal interactions or keeps track of electronic communications.
Right against domestic violence
The Domestic Violence Act 2005, is a shield against all forms of abuse and discrimination against the patriarchal mindset in India. Under this act, women can ask for protection orders by informing protection officers.
Right against workplace harassment
A woman has the right to report any form of sexual harassment at her place of employment under the Sexual Harassment of Women at Workplace Act. A woman can file an FIR with internal ICC at a branch office.
Right against dowry
According to the Dowry Prohibition Act, of 1961, dowries cannot be accepted or given by brides, grooms or their parents before, after or during marriage. If you or someone is found indulging in giving or taking dowry, you may receive five years in prison and a fine of Rs. 15,000 as a punishment.
Right to free legal aid
If you are a woman who has been harmed, you can ask for legal assistance from a legal authority, authorised under the Legal Service Authority Act, 1987, whether or not you can afford legal representation on your own.
National commission for women act
NCW (National Commission for Women Act) speaks up for Indian women’s rights and gives voice to their problems and issues. It helps in advancing their position and promotes their economic independence.
Right not be arrested at night
A woman cannot be arrested between the hours of dark and sunrise unless there is an unusual circumstance and the arrest is authorised by the first-class magistrate.
Right to anonymity
Women are subjected to uphold the status of the family. Everyone has a right to anonymity but those who have been subjected to sexual assault especially need it. To protect this privacy, a victim of sexual harassment can give an anonymous statement under Section 228(A) of the Indian Penal Code.
Right of private defence
No woman shall be permitted to work, whether as an employee or otherwise, in any establishment between the hours of 9 p.m. and 7 a.m., in summer and 8 p.m. and 8 a.m., in winter, according to section 14 of the Delhi Shops and Commercial Establishment Act, 1954.
